Massachusetts Non-Judicial Foreclosure for Timeshares Effective January 4

Massachusetts Governor Deval Patrick signed the bill enacting non-judicial foreclosure legislation for timeshares on October 6, 2010.  The new law, effective on January 4, 2011 will greatly streamline the process and reduce costs for timeshare foreclosures

ARDA and ARDA-ROC Oppose Legislation Proposing Voluntary Surrender of Timeshare Interests (HB 1658)

If passed, the bill would enable a timeshare owner to voluntarily surrender their timeshare as long as they have no outstanding payments due to the HOA and no other liens on the timeshare, regardless of whether the managing entity has the capacity to take on the financial obligations of ownership of the surrendered timeshare.
